EDB`s FATCA status
On September 11, 2017, the Government of the Republic of Kazakhstan and the U.S. Government signed an Agreement to Improve International Tax Compliance, which determines, in particular, the status of international organizations located on the territory of the Republic of Kazakhstan, for the purposes of the U.S. Foreign Account Tax Compliance Act (FATCA). The Agreement took effect on April 05, 2022.
Pursuant to the above-mentioned Agreement, international organizations, which include any intergovernmental organizations (including supranational organizations), which:
consist mainly of governments other than the U.S. Government;
whose income is not intended for the benefit of private individuals and who have a Headquarters Agreement in force with the Republic of Kazakhstan;
whose income is not intended for the benefit of private individuals;
Are treated as Non-reporting Financial Institutions of the Republic of Kazakhstan and Exempt Beneficial Owners for the purpose of sections 1471 and 1472 of the U.S. Internal Revenue Code (except when payments arise out of obligations associated with commercial financial activities carried out by a Specified Insurance Company, a Custodial Institution or a Depository Institution).
The Eurasian Development Bank (EDB, the Bank) is an international financial institution established in 2006 pursuant to the interstate agreement. The headquarters of the Bank is located at: 220, Dostyk Avenue, Almaty, the Republic of Kazakhstan.
Taking into consideration the international status of the Bank, the nature and the objective of its activities, and subject to the official position of the Ministry of Finance of the Republic of Kazakhstan, the EDB certified itself for FATCA purposes as an International Organization.
The completed W-8BEN-Е self-certification form will be produced on a reasoned request of the contractor.
